Terms of Service

Article 1 (Purpose)

These terms aim to define the rights, obligations, responsibilities, and other necessary matters between Mocha INC. (hereinafter "Company") and users regarding the use of MochaFace service (hereinafter "Service") operated by the Company.

Article 2 (Definitions)

Article 3 (Posting and Amendment of Terms)

1. The Company posts the content of these terms on the initial screen of the Service for easy user access.
2. The Company may amend these terms within the scope that does not violate relevant laws such as the "Act on the Regulation of Terms and Conditions" and the "Act on Promotion of Information and Communications Network Utilization and Information Protection."
3. When the Company amends the terms, it will specify the effective date and reason for amendment and announce them along with the current terms on the initial screen of the Service from 7 days before the effective date until the day before.
4. If users do not agree to the amended terms, users may discontinue service use and terminate the usage agreement.

Article 4 (Service Provision)

1. Services Provided by the Company

• AI-based face analysis and first impression evaluation service
• Analysis result report provision
• Analysis history management (members only)
• Analysis result sharing feature
• Other services determined by the Company

2. Service Hours

The service is provided 24/7, 365 days a year in principle. However, days or times determined by the Company for regular maintenance or other needs without special business or technical obstacles are exceptions.

Article 5 (Member Registration)

1. Users apply for membership by filling in member information according to the registration form set by the Company and expressing consent to these terms.
2. The Company may not approve or may terminate the usage agreement for applications falling under the following:
   • Using a false name or another person's name
   • Entering false information or not entering content presented by the Company
   • Children under 14 without legal guardian's consent
   • When approval is impossible due to user's fault or violates these terms

Article 6 (Change of Member Information)

Members can view and modify their personal information anytime through the personal information management screen. Members must notify the Company of changes through online modification, email, or other methods when registration information changes.

Article 7 (User Obligations)

Users must not engage in the following activities:

1. Registering false content during application or change
2. Identity theft
3. Unauthorized modification of information posted by the Company
4. Transmitting or posting information prohibited by the Company
5. Infringement of intellectual property rights including copyrights of the Company and third parties
6. Acts damaging the reputation or interfering with business of the Company and third parties
7. Publishing or posting obscene or violent content on the service
8. Other illegal or unfair acts

Article 8 (Copyright Attribution and Usage Restrictions)

1. Copyrights and other intellectual property rights for works created by the Company belong to the Company.
2. Users must not use information with intellectual property rights belonging to the Company for profit or allow third parties to use it through reproduction, transmission, publication, distribution, broadcasting, or other methods without prior consent from the Company.
3. Copyrights for content posted by users within the service belong to the respective users.

Article 9 (Service Usage Restrictions)

The Company may gradually restrict service use through warnings, temporary suspension, or permanent suspension if users violate these terms or interfere with normal service operation.

Article 10 (Disclaimer)

1. The Company is exempt from service provision responsibility when unable to provide service due to natural disasters or force majeure.
2. The Company is not responsible for service use obstacles due to user's fault.
3. The Company is not responsible for the reliability, accuracy, etc. of information, materials, or facts posted by users related to the service.
4. The Company is exempt from responsibility for transactions between users or between users and third parties through the service.

Article 11 (Dispute Resolution)

1. The Company establishes and operates a damage compensation processing organization to reflect legitimate opinions or complaints raised by users and compensate for damages.
2. The Company prioritizes processing complaints and opinions submitted by users. However, if prompt processing is difficult, the Company immediately notifies users of the reason and processing schedule.
3. When users request damage relief regarding e-commerce disputes between the Company and users, the Company may follow mediation by dispute resolution organizations commissioned by the Fair Trade Commission or mayors/governors.

Article 12 (Jurisdiction and Governing Law)

1. Lawsuits regarding disputes between the Company and users shall be under the jurisdiction of Seoul Central District Court.
2. Korean law applies to lawsuits filed between the Company and users.

Supplementary Provisions

Article 1 (Effective Date)
These terms are effective from January 1, 2025.

Article 2 (Transitional Measures)
These terms also apply to members who joined before the implementation of these terms.
